Ein Domainname wird gehalten, ohne für eine Website oder E-Mail genutzt zu werden. UDRP-Panels gehen seit dem Telstra-Fall von 2000 davon aus, dass auch die Nichtnutzung einer Domain als bösgläubige Nutzung gelten kann, wenn alle Umstände darauf hindeuten, etwa eine berühmte Marke und falsche Kontaktdaten.
