# Complainant loses bid to take over sattamatkajico.com

## in plain words

A man from India asked for a website name to be taken from its owner. A panel said the words were a common name for a popular betting game, so his request failed. The panel also said he should have known he could not prove the owner had targeted him.

A WIPO panelist has ruled that Rikshiram Aghria tried to reverse hijack the domain name sattamatkajico.com. Reverse domain name hijacking is a claim made in bad faith to take a domain from its holder.

Aghria filed the complaint under the UDRP, the dispute process for domain names, citing Indian trademark registrations for the marks SATTA and SATTA MATKA in stylized form. The panelist, Shwetasree Majumder, found that the term is generic. Satta matka is a numbers-based gambling game that originated in India, and players bet on a number drawn from an earthen pot.

Majumder said the complainant relied on trademark applications filed weeks before the domain was registered. She said it used the term as the name of a betting game while calling it coined, and it offered no evidence of use to support its claim of goodwill built over years. She also said the complainant knew, or ought to have known, that it could not show the respondent had targeted it.

Both parties represented themselves in the proceeding.
