WIPO专家组认定丹麦语绿色能源公司WindSpace A/S存在反向域名劫持行为。该公司曾根据Uniform Domain Name Dispute Resolution Policy对域名windspace.com提出投诉。专家组的认定意味着，该投诉的提起方式被专家组认为不当。

该域名注册于1999年，早于WindSpace A/S成立多年。此后多年间，该域名经多次收购转手，先后归属多家绿色能源公司。2009年，该公司曾询问购买该域名，但当时正在使用该域名的持有人拒绝了报价。WindSpace A/S又在2014年和2022年两次尝试购买，均遭拒绝。

Panelist Sebastian Hughes认定，该公司未能证明域名持有人缺乏权利或合法利益。他还认定，该公司也未能证明该域名系出于恶意注册和使用。在他看来，该公司本应知道无法证明恶意，因为该域名注册时间远早于其业务成立及其丹麦商标权。

专家组还指出，该公司在2009年就已知道持有人正将该域名用于西班牙一家独立的可再生能源业务。专家组补充认为，持有人在13年间多次拒绝出售，使恶意认定的可能性降低。鉴于WINDSPACE一词在可再生能源领域的含义，专家组表示，该公司也无法通过消极持有证明恶意。
